1. ACCEPTANCE OF TERMS AND CONDITIONS

1.1 These Terms of Service (“Terms”) are a binding contract between you as the user (“User”) of the services provided by Vouxly ApS (“Vouxly”).

1.2 These Terms govern your use of Yearly Cards (“Service”), accessible at yearly.cards.

1.3 By creating an account, placing an order, or otherwise using the Service, you agree to these Terms, which remain in effect while you use the Service.

1.4 Vouxly may update or modify these Terms from time to time as set out in Clause 12.

2. ABOUT THE SERVICE

2.1 Yearly Cards is a service that allows users to schedule physical cards to be printed and mailed to recipients on their behalf, automatically, on a recurring annual basis.

2.2 The User provides the recipient’s name, mailing address, a date on which they would like a card to be delivered, and a personal message. Yearly Cards arranges for a physical card to be printed and mailed to the recipient’s address on or before the specified date, and to repeat this annually for as long as the subscription remains active.

2.3 Cards are physical cards sent via postal mail. Delivery times depend on the postal service in the recipient’s country and are outside Vouxly’s direct control.

2.4 Yearly Cards does not guarantee delivery by a specific date. We aim to mail cards 5–7 business days before the specified occasion to allow for standard postal delivery. However, postal delays are beyond our control.

3. ACCOUNT REGISTRATION AND ELIGIBILITY

3.1 To use the Service, you must create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date.

3.2 You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.

3.3 You must be at least 18 years of age to use the Service.

3.4 You may only create one account per person. Vouxly reserves the right to terminate duplicate accounts.

4. USER RESPONSIBILITIES AND DATA ACCURACY

4.1 You are solely responsible for the accuracy of all information you provide, including recipient names, mailing addresses, and card messages.

4.2 Recipient Data. By providing a recipient’s personal data (name, address, dates), you represent and warrant that:

  • You have a legitimate personal relationship with the recipient.
  • You have the right to provide the recipient’s personal data to us for the purpose of sending them a physical card.
  • The information you provide is accurate and current.
  • The card and message content is lawful, non-threatening, non-harassing, and does not violate the rights of any third party.

4.3 You are responsible for updating recipient information (such as address changes) to ensure successful delivery. Vouxly is not responsible for failed deliveries due to incorrect or outdated addresses provided by the User.

4.4 Vouxly reserves the right to refuse to print or send any card that, in its sole discretion, contains content that is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable.

5. PRICING AND PAYMENTS

5.1 Yearly Cards is priced on a per-card, per-year basis. The current price is displayed on the website at the time of purchase.

5.2 Payment is processed at the time of card setup through our payment provider (LemonSqueezy). The payment covers one year of the card service (one physical card, printed and mailed).

5.3 Cards are set to renew annually. You will be notified before each renewal and charged the applicable rate at that time. You may cancel a card at any time before the renewal date to avoid being charged for the next year.

5.4 All prices include printing and standard postage to the recipient’s address. International delivery may be subject to availability and is indicated during setup.

5.5 Prices may change. Any price changes will apply to new orders and renewals, not to already-paid card subscriptions.

6. CANCELLATIONS AND REFUNDS

6.1 You may cancel any scheduled card at any time through your account. Cancellation takes effect for future sends — if a card has already been printed and mailed for the current year, that send cannot be reversed.

6.2 If a card has not yet been printed or mailed for the current period, you may request a full refund by contacting us at [email protected].

6.3 If a card is returned as undeliverable due to an incorrect address provided by the User, Vouxly is not obligated to issue a refund. We will attempt to notify you so you can update the address for future sends.

6.4 If a card is not delivered due to an error on Vouxly’s part, we will work with you to resolve the issue, which may include re-sending the card or issuing a refund.

7. ACCESS AND USER RESTRICTIONS

7.1 The User obtains non-exclusive access to the Service. The User does not acquire ownership of the Service or any copy or part thereof.

7.2 The User shall not (directly or indirectly):

  • copy or reproduce the Service,
  • modify, reverse engineer, or disassemble the Service,
  • decompile, attempt to derive the source code or underlying ideas or algorithms of any part of the Service,
  • create derivative works based on the Service,
  • interfere with or disrupt the integrity or performance of the Service,
  • attempt to gain unauthorized access to the Service or its related systems or networks,
  • use the Service to send unsolicited, harassing, or bulk mail,
  • use the Service for any unlawful purpose.

7.3 Vouxly reserves the right to suspend or terminate your account and refuse any current or future use of the Service if you violate these Terms.

8. LINKS

8.1 The Service may contain links to third-party websites. Vouxly does not control or monitor these sites and is not responsible for their content or availability.

8.2 Access to third-party websites is at the User’s own risk.

9. USER DATA AND PRIVACY

9.1 All personal data is processed in accordance with our Privacy Policy available at: https://yearly.cards/privacy

9.2 You retain all rights to the content you provide (card messages, recipient information). By using the Service, you grant Vouxly a limited license to use this content solely for the purpose of fulfilling the card service (printing and mailing cards).

9.3 Vouxly may retain payment and transaction information as required by applicable accounting and legal obligations.

10. OPERATIONAL STABILITY

10.1 Vouxly strives for the highest possible operational stability but is not liable for breakdowns or disruptions caused by factors beyond its control, including power outages, internet disruptions, hacker attacks, viruses, or force majeure events.

10.2 In the event of disruption, Vouxly aims to restore normal operation as quickly as reasonably possible.

10.3 Vouxly is not responsible for delays or failures caused by postal services, printing partners, or other third parties involved in the physical delivery of cards.

11. INTELLECTUAL PROPERTY RIGHTS

11.1 The Service and related intellectual property rights (including card designs, website design, and branding) belong to or are licensed to Vouxly.

11.2 No intellectual property rights are transferred to the User. The User acquires only a limited right to use the Service as described in these Terms.

11.3 Card designs provided by the Service are licensed for use within the Service only and may not be reproduced, distributed, or used outside of Yearly Cards.

11.4 If the User becomes aware of unauthorized use of the Service, the User shall notify Vouxly.

12. LIMITATION OF LIABILITY

12.1 IN NO EVENT SHALL VOUXLY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO FAILED OR LATE CARD DELIVERIES, EMOTIONAL DISTRESS, OR RELATIONSHIP HARM.

12.2 VOUXLY DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

12.3 VOUXLY DOES NOT GUARANTEE SPECIFIC DELIVERY DATES. WHILE WE AIM TO HAVE CARDS ARRIVE ON OR BEFORE THE SPECIFIED DATE, POSTAL DELIVERY IS OUTSIDE OUR CONTROL.

12.4 Vouxly’s total liability shall not exceed the amount paid by the User for the specific card or subscription giving rise to the claim.

13. CHANGES TO THE TERMS

13.1 Vouxly may change these Terms at any time. The current version will be available on the Service website.

13.2 For material changes, we will provide notice to active users via email at least 14 days before the changes take effect.

13.3 Continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree with updated Terms, you may cancel your account and any active card subscriptions.

14. CHOICE OF LAW AND JURISDICTION

14.1 These Terms are governed by the laws of the Kingdom of Denmark.

14.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Denmark, with the Municipal Court in Copenhagen as the court of first instance.

14.3 If any provision is declared void or unenforceable, the remaining provisions remain valid.

14.4 For consumers located in the EU, mandatory consumer protection laws of their country of residence apply in addition to these Terms.
